Service Terms & Disclaimer

 

1. Scope of Work

Silver Strike Painting, LLC provides residential and commercial painting services based on the scope of work agreed upon in the written estimate or contract. This scope includes only the services, surfaces, and details specifically outlined. Any additional work requested outside of the original agreement will be considered a change to the scope of the project and may result in additional charges, timeline adjustments, or both.

 

2. Color Selection Responsibility

The client is solely responsible for the selection and approval of all paint colors, finishes, and materials prior to the start of the project. While we may offer guidance or recommendations, final decisions rest with the client. Once paint has been applied, Silver Strike Painting, LLC is not responsible for dissatisfaction with color choices. Any changes requested after application has begun or been completed may require additional labor, materials, and cost.

3. Changes During the Project

Any modifications to the project scope, including but not limited to color changes, additional areas, repairs, or upgraded materials requested after work has commenced, will require a revised estimate or change order. These changes may affect the total project cost, required materials, and completion timeline. Work on additional requests may not begin until both parties agree on updated terms.

4. Surface Conditions and Repairs

Silver Strike Painting, LLC will take reasonable care to prepare surfaces for painting; however, we are not responsible for underlying structural issues, hidden damages, or pre-existing conditions such as rot, mold, water damage, moisture intrusion, or previous improper coatings. Any necessary repairs beyond standard preparation may result in additional charges and must be approved by the client before proceeding.

5. Project Delays and Conditions

Project timelines are estimates and may be affected by factors outside of our control, including weather conditions, temperature fluctuations, humidity, material availability, unforeseen surface conditions, or client-requested changes. We will make reasonable efforts to communicate delays and adjust schedules accordingly.

6. Client Responsibilities

The client agrees to provide clear access to work areas, including moving furniture, vehicles, or other obstacles as needed, unless otherwise agreed upon. The client is also responsible for securing pets, valuables, and sensitive items. The client further acknowledges responsibility for maintaining the property in a condition suitable for painting, including addressing leaks, moisture issues, or ventilation problems. Delays or issues caused by lack of access, environmental conditions, or unprepared spaces may result in additional charges or rescheduling.

7. Payment Terms

Payment terms will be outlined in the project estimate or contract. Any additional work, change orders, or unforeseen repairs must be paid according to the updated agreement. Failure to make payments as agreed may result in work stoppage or project delays.

8. Warranty Disclaimer

Silver Strike Painting, LLC does not provide a separate or additional workmanship or product warranty beyond proper application of materials as outlined in the project scope. Any warranties related to paint, coatings, or materials used are provided solely by the product manufacturer. The client understands and agrees that it is their responsibility to review manufacturer warranty terms and to file any warranty claims directly with the manufacturer if issues arise.

The client further acknowledges that Silver Strike Painting, LLC is not responsible for paint failure or defects resulting from conditions beyond our control, including but not limited to moisture intrusion, water damage, leaks, humidity, temperature changes, structural movement, improper ventilation, or pre-existing surface conditions. Issues such as peeling, blistering, cracking, or staining caused by these factors are not covered under any service guarantee or responsibility of Silver Strike Painting, LLC.

9. Final Walkthrough and Acceptance

Upon completion of the project, the client will be given the opportunity to perform a final walkthrough to review the work. Any concerns or touch-up requests must be identified at that time. Once the walkthrough is completed and the client provides approval, whether verbally, in writing, or through final payment, the project will be considered complete and accepted.

Failure to participate in a final walkthrough within a reasonable timeframe, or occupancy/use of the painted space, shall constitute acceptance of the work as completed. Any additional work requested after acceptance, including touch-ups or changes, may be subject to additional charges.

10. Limitation of Liability

Silver Strike Painting, LLC is not liable for issues arising from client-selected materials, colors, or finishes, nor for damages related to pre-existing conditions, environmental factors, or improper prior work. Our liability is limited to the value of the services provided under the agreement.

11. Acceptance of Terms

By approving an estimate, signing a contract, or allowing work to begin, the client acknowledges and agrees to these terms and conditions.

13. Privacy Policy

Silver Strike Painting, LLC respects your privacy and is committed to protecting any personal information you provide. We may collect basic contact and project information, including your name, phone number, email address, and property address, for the purpose of providing estimates, scheduling services, communicating about your project, and processing payments.

We do not sell, rent, or share your personal information with third parties for marketing purposes. Your information may only be shared with employees, subcontractors, or service providers as necessary to complete your project or process payments.

Any photos taken of the project may be used for documentation or portfolio purposes unless the client requests otherwise in writing prior to the start of the project.

We take reasonable measures to protect your information; however, no method of transmission or storage is completely secure. By engaging our services, you acknowledge and agree to the collection and use of your information as described in this section.
